Establishing Paternity
Establishment of paternity is the process for making a legal determination of the identity of a child's father. When a couple is not married, a paternity action can be filed for several reasons:
- To obtain child support
- To obtain health insurance through an employer
- To protect the child's right to benefits if the father passes away
- To recognize a father's the legal right to custody or visitation of the child
In New Jersey, paternity can be established when a father signs a voluntary acknowledgement called a Certificate of Parentage (COP). It can also be established through a series of legal steps, including court-ordered DNA testing.
DNA tests for paternity usually require a saliva sample. The sample must be at least a 95% match for paternity to be declared.
